My daughter had an accident [protected] at this Walmart store #1804. She was sitting on the bottom edge of the cart while I was looking at an item on the shelf and she rolled the cart and got her index finger stuck in the wheel and the metal piece and it ripped her fingernail down to her first knuckle. We went to the front of the store so I could better access the finger in the bathroom. It was worse than I thought. We went out because I was going to leave my cart up front and a manager and two other staff members were waiting for me. They were very helpfull in getting my four (4) year old daughter calmed down enough to bandage the finger and get our information. I was told a call back would be given to me that following Sunday to check on her. I informed them I wanted a claim filed and I was taking her to the hospital. The co-manager was very helpful and directed me to do such as well.
The problem started when no call back was given to me and when I called Monday I got a lady who was not to eager to talk to me and said I hope she is doing better. I asked for claim information and she said I would receive a call in a few days. No cal came and I called on [protected] three times to no avail because she was in the office and no one else could speak with me regarding the issue.
I finally get a response on the 24th of May only to tell me that they needed to file the info and someone would call me. I stated I was told that last week. She said she would get it initiated.
This is a 4 year old girl, who yes shouldn't have been sitting on the cart but had an accident and no one is taking responsibility on getting this resolved. Her fingernail had to be surgically removed and stiched back on to avoid her nail bed from being damaged any further then it already had. A four year old girl who now has to worry about her nail looking ugly.
I am going everywhere I can to file a complaint-this is ridiculous customer service. This is supposed to be a family store but they have no care in the world! I fear what they do for other chidren who have accidents with there non-children friendly shopping carts!

That's not an injury, that's a scratch. And that's an awfully fat hand for a 4-year old. I'd wager that's either Moomy's hand or she's feeding her little snowflake too many HoHos.

Lawsuits are designed (supposedly) to compensate someone for a loss. You have to be able to show that damages were incurred because of WalMart's negligence or malfeasance. And the compensation is supposed to be an adequate monetary replacement for that loss. For a fingernail injury on a 4 year old, you would be entitled to, if WalMart were at fault, only what the kid's medical bill cost and nothing more.

What you have here is a situation where a [censored] mother allows her child to stick a finger into a known hazard. The cart worked as it was supposed to, and no one affiliated with WalMart made your child stick her finger where it wasn't prudent (despite warnings). Basically your complaint is on par with allowing your child to stick a fork in a light socket and then complaining to the electric company that electricity isn't child-friendly.

Fortunately you're probably too stupid to bring a lawsuit, and I doubt a lawyer would take your case considering that you wouldn't be able to pay for it with food stamps.

YOU are the parent and it is your responsibility to watch your child, supervise your child and keep them from harm. You failed at doing your job so you want Walmart to pay? I am truly boggled that your mind even goes in that direction and frightened that this line of thinking apparently makes sense to you. You do not deserve so much as one thin dime, and I hope Walmart gives you ZERO, which is the amount you are "owed".

Just because you "turned your back" for a few seconds" does not mean that Walmart automatically steps into the void created by your inattention and does your parenting job for you. Life doesn't work that way. Too bad your child thinks their fingernail looks ugly, perhaps they will learn caution from this incident and not mess with mechanical equipment they don't understand.

Do your parental duties correctly and appropriately while in public or leave your child home with a sitter.

Lastly, why on earth was your daughter on the bottom of the cart, a HUGE and screamingly obviously dangerous thing to do? Absolutely unbelievable sense of entitlement to ask for compensation for actions resulting from your negligence, plain, pure parental negligence on your part. YOU are to blame for this accident, not Walmart, not bystanders, just YOU. Get pissed at posters all you want, that doesn't change the fact that the onus of this situation rests firmly on your shoulders.

After reading Meagans responses I'm pretty sure this is a made up story. She just wants to stir up some ### and argue with people. Probably doesn't even have kids. Either that or she is a kid with a kid. She is probably no more than 15 if she is telling the truth.

Why did you let her sit there? She should have been in the shopping cart seat or better yet holding your hand. Now you want Walmart to pay for your negligence as a parent. You are the one that put your child in harms way when you allowed her to sit there, and you should be held liable for all medical cost. People like you are why we have to pay more for products today. Walmart will just pass along the cost to us (the consumer) to recover their loss. Learn from this, and please next time keep an eye on your child wherever you are to help prevent things like this happening again.

Wow looking for them to pay the bills on this one. When everyone is there right mind whould let thier kid sit/stand on the bottom of the kart? Key words "She was sitting on the bottom edge of the cart" I work in a store like that and i do say something to the mothers that let the kids lay on the bottom of the kart while they shop through the store! Wheels easy to run fingurers over like it did to your child or thier hair gets stuck in it casue damage to thier neck. or Standing on it and running over the foot witch i did have it happen to me when i was young crushing my foot with the weaight of the kart. No my parents did not sew or make a big deal about it because it was thier fault for letting me stand on it. I sliped and it ran my foot over.. Karts make a special seat in the kart for that reason. Parents are resposible for thier kids and should leaurn to control them. I see kids everyday in the store running around sitting on shelving again if the self fell parents try and sew when they know that its not made for that. like the little shopping karts i see kids trying to fit them selves in them again parents allow it but when it brakes or they get hurt they blame the store.. hello its not made for it. So i think you should re-think your complate again and how you are over re-acting they didnt hold a gun to youre head and tell you make ur kid use the kart. They dont tell you that your kid can sit/lear or stand on it that way.. your a mother so use your head.

4 years children shouldn't get this happen. Poor her... I am not saying Mom has no responsibility at all but under this situation, Walmart does have some certain level of responsibility. First, they shouldn't have this kind of cart to have room letting children sitting on. Second, this was happen inside Walmart area, Walmart still have liability. Third, is there any sign to remind parents not putting their child on the cart? or any kind of wording like..."take your own risk" ? if not, Walmart should have to take care of this.

I would recommend you should consult any legal consultant or lawyer. I agree Walmart shouldn't avoid your claim.

Looks like my post did not go through, anyways wal-mart is somewht to blame. If they did not want children sitting on the bottom of the cart they would have not made it wide enough for a children. They have some level of responsibility. Don't all blame the mother. This did happen inside the store after all so they have liability. They do not warn parents that they should put the child inside the cart so don't blame me I am not a bad mother she loves her child or would not be fighting for my daughter. They should have taken care of the child's medical bill instead of blaming the mother.

I am a former personal injury paralegal and I can say with confidence that none of the attorneys I worked for would have accepted your case. Walmart is not at fault here.

I don't blame your parenting skills either. Heck, accidents happen all the time. With little kids, you can turn your back for 1/2 second and WHAM! something happens, just like that.

I admit I didn't read all of the comments here arguing or bashing her parenting skills, but I was in walmart recently when a woman had at least 4 kids sitting in the basket when one fell out. Never did anyone tell her it was her fault although I agree it very much was. Walmart had paperwork for her to fill out as the ambulance was loading her daughter that stated they only pay medical bills of incidents in their store and she could not sue later, she was quite worked up and was reading most out loud. Tthey do take responsibility for accidents happening in their store here at least whom evers fault.

Le's say you take this case to court.

The attorney will ask you. "Why wasn't your child in the seat?
Your reply, "Cart was defective." Then he come back then why didn't you get another one?"

Another question that will be asked, " How did your daughter hurt her finger?"
Tell them why. Then here comes the case breaker, "I turned my back."

Years ago I remember a story about Adam Walsh. His parents turn their backs on him, he got lost. He got kidnapped and murdered.

I'm sure your a great mother, your concerned about your beautiful daughters finger. But it is a good practice to never turn your back on your children, no matter if their 4 or 14. All it takes is one second. That second a child can drown, choke, get bit by an animal, get kidnapped or get into an accident. As a father myself. I can tell you this not out of hate but sincerity. We as parent are charged with raising, protecting, loving, and teaching our kids.

Ok here is the part where you may think I'm pinning the blame on you. May be I am. But I'm telling you the truth. Walmart is not responsible for you precious girl, she is your daughter not theirs. For turning your back, well I don't it too. I'm guilty of it also and my daughter got a busted lip. But it wasn't the stores fault, I'm the one who turned my back. The store was impressed with my attitude they still offer to pay medical. I told them it won't be not necessary.

I'm sorry to here about her finger. I'm sorry your having a tough time. Just learn from this experience. Love your daughter, give her a hug and kiss and let your know your sorry your turned your back .

This is hysterical... just the first week of June my 2 year old son was walking from the outside to the inside of the garden center slipped and fell on a water spot on the back of his head. There were NO signs posted. Immediately the employees called the higher ups to take an incident report. I explained that I didn't think it was too serious, just a little bump. So obviously THEIR FAULT, but no true harm no foul. Now just yesterday he was getting himself a 4 pack of Chef Boyardee that were stacked at his level 2 high. He grabbed the top and the bottom one slid off the shelf and busted right off his toe. He immediately fell to the ground rolling and crying as I watched his toe turn purple. Another report filed and to the ER we went. His toe was not broken, but they had to put a hole through the middle of his nail to drain all the blood. Now he has to soak his toe in peroxide for the next 5 days and watch for infection and wait for his nail to fall off. GREAT experience for a 2 year old to go through. Am I as crazy trying to get them to give their blood back? NO. Why? How bout you calm down a bit and think about the fact that YOU were in the wrong. Not Walmart, not the cart company, certainly NOT your 4 year old, just YOU. Hope karma is on your side later on life.

Its people like you who shouldn't be allowed to have kids. If you can't keep control of your children then you should not be out in public. You kid should have been sitting in the card instead of being loose to run rampant. Nothing pisses me off more when I go to Walmart than seeing fat parents letting their kids run all over the place while they go shopping. You know I hate Walmrt and refuse to shop there, but a senseless lawsuit is a frivolous lawsuit. I asked an attorney friend of mine about this, and he said your case holds no water. You should have followed the directions and rules of the store. The cart specifically says DO NOT LET CHILDREN RIDE IN THE BOTTOM OF THE CART. If you falied to read the disclaimer and follow the rules then you deserve the hospital bills. If you try to take this to court Walmart can counter sue you for being Negligent of their policies and the court can fine you for frivolous accusations. They can also sue you for slander, like what you are doing here, but your case holds no water. Be careful they can also get you kid taken away for your negligence as a parent. Your daughter was injured because YOU failed to follow policy and the rules of the store. YOU allowed your daughter to ride in the bottom of the cart. YOU weren't watching her, for a second or not. And THEY have your Negligance on VIDEO to prove you are UNFIT. They hold all the cards. No one is saying you are a bad parent, but trying to get something out of Walmart for your mistake is rediculous. You may not see it, but we all do.

Judging by the poor english on their website, I would guess they are not located in the United States. I'm not saying they are or are not a scam. I'm just saying FYI. Shipping will likely take longer than if they shipped from the United States.

its your fault lady. your children are your responsibility. you said you had your back turned...never turn your back on your kids. thats how they wind up on the back of milk cartons. or wind up on cnn with nancy grace. you said the cart was defective. if you noticed that then why did you still use it? you could have gotten another cart and given that one to a store associate and let them know it was defective. also, the only way the carts flip over would be if your child was jostling and jumping around in it causing it to tip. again, your fault because you wasn't paying attention...your one of those people that purposely flops themselves on the floor in a store and fakes injuries so they can sue...give me a break. go take some parenting classes so you can learn how to watch your child while you shop.

this is hilarious. only in America would someone even think of suing a store for this kind of thing. Truth is, everything can be dangerous if not used properly. it is not walmart's responsibility to make sure you use their carts the right way. are you going to buy some hot soup and scissors from walmart and then pour it on your head and cut off your fingers just so you can sue walmart? Pay more attention to your daughter and stop blaming everyone else.

What the hell was she doing at the bottom of the cart to begin with? She should have been IN IT, or seated in the VERY FRONT! This was NOT walmarts fault! If you want "kid friendly carts" then design and invent one yourself!

Sorry about your kid's injury, but any intelligent adult knows the bottom of the cart isn't for passengers and keeps their kids safe by not letting them go there.

Also have little sympathy for parents who put their kid in the seat but don't fasten the seatbelt.

The seatbelt is there for a reason. That reason is because kids have leaned over the side of the seat and have fallen, bashing their heads on the concrete floor, and some have died or been permanently injured from that fall.

Some people are too dumb to have kids.

You said yourself carts aren't children friendly. why should Walmart pay your medical bills? its not their fault you weren't watching your child. she shouldn't have been sitting in the bottom of the cart in the first place. watch your child better and she won't get hurt. Walmart is not a babysitter.
